Buying Process for Foreigners in Colombia

Colombia is one of the most foreigner-friendly property markets in Latin America. Non-residents enjoy the same full ownership rights as Colombian citizens — there are no restrictions on the type or quantity of property foreigners may purchase, and no requirement to form a local company or hold residency. The legal process is transparent, notary-based, and can typically be completed in 4 to 8 weeks once a property is agreed upon.

 

Step 1 — Property Selection & Due Diligence Our team presents options matching your criteria, arranges viewings in person or virtually, and conducts an initial title check on your preferred property. We verify freedom from liens and encumbrances, unpaid predial taxes, zoning classification, and cadastral status before you commit to anything.

 

Step 2 — Promise of Sale Agreement (Promesa de Compraventa) A legally binding preliminary contract is signed by both parties. A deposit of typically 10 to 20% of the agreed purchase price is paid by the buyer to reserve the property. The promesa establishes the price, payment conditions, and target closing date.

 

Step 3 — Legal Review & Notary Preparation A Colombian notary and your property lawyer review all title documents, the certificado de tradición y libertad, and cadastral records. Foreign buyers should have a valid passport and, ideally, a Cédula de Extranjería for the transaction. For working farms, your lawyer will also review any existing tenancy agreements or agricultural labour contracts.

 

Step 4 — Deed Signing & Balance Payment The final escritura pública is signed before a Colombian notary. The remaining balance is transferred and the deed is officially executed and witnessed. Payment is made via wire transfer or certified cheque — cash transactions are not recommended and are subject to regulatory reporting requirements.

 

Step 5 — Registration & Transfer of Title The signed deed is lodged with the Oficina de Registro de Instrumentos Públicos. Once registered — typically within 5 to 15 business days — you are the legal, registered owner of record. The registered deed and updated certificate of tradition are provided to you as confirmation.

You are not required to be physically present in Colombia throughout this process. With a notarised poder (power of attorney), your lawyer or our team can represent you and sign at the notary on your behalf. Many of our international clients complete their purchase entirely remotely, travelling to Jericó only to take possession of their new property.

 

6 · Cost of Ownership

Cost of Ownership in Jericó

Property tax (Predial) — approximately 0.5 to 1.2% of cadastral value. Cadastral value is usually well below market value, so the real annual cost is very low. Water & electricity — approximately $30 to $80 USD per month. Jericó has among the lowest utility rates in Antioquia. Caretaker / administrator — approximately $250 to $500 USD per month. Essential for rural fincas or absent owners; covers maintenance, security, and basic crop management on working farms. Home insurance — approximately $300 to $700 USD per year for fire and earthquake coverage on a mid-range residential property. Administration fee — approximately $30 to $80 USD per month, applicable only to apartment buildings or gated residential communities.

Currency & Repatriation

 

Colombia imposes no restrictions on the repatriation of capital gains from property sales. Foreign buyers who formally declare their currency exchange at the time of purchase via a declaración de cambio filed through a Colombian bank may repatriate full sale proceeds when they exit the investment, net of Colombian capital gains tax, currently set at 15% on gains.
